Overview

Letters of Administration prove to the world that a person (the administrator) is entitled to deal with the estate and collect the assets of the person that has passed away. Letters of Administration are appropriate where a person has died without a will (known as intestacy) or where there is a will, but either it does not name an executor or nobody named as an executor is willing or able to act. If there is a will and it names an executor who is willing and able to act, a grant of Probate would instead be appropriate. Costs incurred making an application for Letters of Administration (including our fees) can be reimbursed by the estate.

How much does it cost?

Our basic Letters of Administration service starts at $990 (inclusive of GST) plus outlays. This assumes the application is uncomplicated and uncontested. Not included in our fees is the application fee of $748.10 payable separately to the Supreme Court. This fee may be reduced to $136.50 for eligible concession card holders.  An additional fee of $161.70 payable to the Incorporated Council of Law Reporting for the State of Queensland applies for advertising the application. Not all cases fall in to this category however and sometimes additional costs will apply. We’ll take a look at your situation and provide an obligation free quote based on your individual circumstances.

How long does it take?

It can take up to 3 months from receiving your instructions for a grant of Letters of Administration to be obtained. There are minimum time requirements surrounding advertising and notifying the public trustee that must be complied with before the application can be lodged with the Supreme Court. The workload of the Supreme Court registry can also influence how long an application takes.
