Why you need a will.

Every adult should have a will. If you die without a will your property will be divided up according to the law without taking into account your wishes. Consider the following scenarios:

  • If you are married with young kids and die without a will, unless your estate is small, your spouse will not inherit your entire estate. This could leave a lot of your estate tied up in a trust for your kids which could be better spent on their upbringing. It could also mean your spouse will need to bring a family provision application, eating up your estate in legal fees.
  • If you don’t have a spouse or children and die without a will, your estate will be shared equally between your parents. Nobody else will get anything.
  • If you have separated from your husband or wife but not yet divorced and die without a will, your ex could receive your entire estate. If you have a new partner, they might have to share your estate with your ex, or even miss out completely.
  • If you die without a will, you will not have a say in who looks after your estate and how they make decisions.
