Lowest Fee Guarantee – Terms and Conditions

The following terms and conditions apply to our lowest fee guarantee (the “Guarantee”).

1. The services to which the Guarantee apply is limited to:
(a) standard applications for probate;
(b) standard applications for letters of administration; and
(c) standard reseals of interstate grants,
as described here
(together, the “Guaranteed Services”)

2. Pursuant to the Guarantee, if we decide to provide legal services to you in relation to one or more Guaranteed Services, we will beat any competitor law firm’s written quote or advertisement by 5%, subject to these terms and conditions.

3. The Guarantee applies to GST inclusive professional fees only and does not include disbursements we incur on your behalf such as court filing fees or advertising costs.

4. To qualify for the Guarantee, a potential client must provide:
(a) A current written quote from a competitor law firm dated within the last 30 days; or
(b) Evidence of a competitor law firm’s advertised price for the Guaranteed Services from the last 30 days.

5. The written quote of advertised fee from the competitor law firm described in paragraph 3 must:
(a) be from a law firm in Australia legally entitled to provide the Guaranteed Services;
(b) be for legal services substantially similar in scope and complexity to the Guaranteed Services;
(c) clearly itemise or described the services to be provided;
(d) specify the total professional fees (excluding disbursements) and indicating whether or not that amount includes GST; and
(e) be genuine and unconditional and available to the general public.

6. We reserve the absolute right, in our sole discretion, to:
(a) verify the authenticity of any advertisement by contacting the competitor law firm directly;
(b) determine whether the competitor law firm’s services to which the advertisement or quote relate are substantially similar to the Guaranteed Services;
(c) assess whether the advertisement or quote is genuine, unconditional and available to the general public.
(d) reject any claim that appears fraudulent, misleading or otherwise not made in good faith.

7. We may withdraw of modify the Guarantee at any time without prior notice.

8. The firm may refuse to provide legal services to any person without providing a reason. The Guarantee is limited to the price at which legal services are provided and does not constitute an offer to provide legal services.

9. These terms and conditions are governed by the law of Queensland and may be amended at any time.
